Laboratory Testing Terms and Conditions
LABORATORY TESTING TERMS & CONDITIONS
Effective Date: 1st September 2025
1. INTRODUCTION
These Terms and Conditions ("Laboratory Terms") govern the provision of laboratory testing services ("Laboratory Services") by Newfoundland Diagnostics Ltd ("we", "us", "our"), company number 13095376, registered at 3a Station Road, Amersham, Buckinghamshire, HP7 0BQ.
These Laboratory Terms are separate from and additional to any terms governing the purchase of rapid diagnostic test kits from our website.
2. SERVICE DESCRIPTION
2.1 We provide access to laboratory testing services
2.2 The Laboratory Services include:
- Sample collection kit provision
- Sample analysis by UKAS-accredited laboratories
- Digital delivery of results via the portal
- Access to results interpretation where clinically appropriate
2.3 These tests are for health screening and monitoring purposes only and do not constitute medical diagnosis or medical advice.
3. ORDERING AND ELIGIBILITY
3.1 You must be 18 years or older to order Laboratory Services.
3.2 By ordering, you confirm:
- You are legally capable of entering into binding contracts
- All information provided is accurate and complete
- You understand the limitations of the testing services
- You will seek appropriate medical advice for any concerning results
3.3 We reserve the right to refuse or cancel orders where:
- Testing is clinically inappropriate
- Safeguarding concerns exist
- Regulatory restrictions apply
4. PRICING AND PAYMENT
4.1 Prices are displayed at the point of purchase and include:
- Sample collection kit
- Laboratory analysis
- Results delivery
- Standard UK delivery
4.2 Payment is required in full at the time of ordering.
4.3 All prices include VAT where applicable.
5. SAMPLE COLLECTION AND RETURN
5.1 You must:
- Follow all collection instructions precisely
- Complete all required documentation accurately
- Return samples within the specified timeframe
- Use only the provided collection materials
5.2 Samples not meeting requirements may be rejected without refund if due to user error.
5.3 Time is of the essence for sample return. Delayed samples may produce unreliable results or be rejected.
6. LABORATORY ANALYSIS
6.1 Analysis is performed by third-party UKAS-accredited laboratories.
6.2 Turnaround times are estimates only:
- Standard: 2-3 working days from sample receipt
- Complex tests: up to 7 working days
- Delays may occur due to factors outside our control
6.3 We do not guarantee specific turnaround times.
7. RESULTS DELIVERY
7.1 Results are delivered electronically via secure portal.
7.2 You are responsible for:
- Maintaining confidentiality of your login credentials
- Providing accurate contact information
- Checking for and accessing your results
7.3 We are not responsible for delays in you accessing results due to:
- Incorrect contact details
- Technical issues with your devices
- Failure to check the portal
8. CLINICAL LIMITATIONS
8.1 Important Medical Disclaimer:
- Laboratory tests are screening tools only
- Results do not constitute medical diagnosis
- Negative results do not guarantee absence of conditions
- Positive results require clinical confirmation
- Always consult qualified healthcare professionals for medical advice
8.2 We strongly recommend discussing results with your GP or appropriate healthcare professional.
9. CANCELLATIONS AND REFUNDS
9.1 Before dispatch: You may cancel your order at any time before the kit has been dispatched and receive a full refund.
9.2 After dispatch but before use:
If you change your mind, you may return the kit within 14 days of receipt, provided it is unopened, unused, and in its original sealed packaging.
For health protection and hygiene reasons, we cannot accept returns of kits that have been opened.
Refunds will be made within 14 days of us receiving the returned kit, less any delivery costs.
9.3 After the kit has been opened or a sample provided: No refund will be available once the kit has been opened, used, or a sample has been sent to the laboratory.
9.4 Failed samples:
If a sample cannot be tested due to a laboratory error, we will provide a replacement kit free of charge.
If a sample cannot be tested due to insufficient or poor-quality collection, we will offer a replacement kit at the standard price.
Any further replacement kits will be charged at full price.
9.5 Inconclusive results: Where results are inconclusive, this will be treated in line with the failed samples policy in clause 9.4.
10. LIABILITY
10.1 Non-excludable liability
Nothing in these terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability which cannot lawfully be excluded under English law
10.2 Limitations
Subject to clause 10.1, we will not be liable for:
- Any indirect, special, or consequential losses
- Loss of profits, business, revenue, or opportunity
- Emotional distress or anxiety arising from use of our services
- Any losses exceeding the total price paid for the relevant test
10.3 Medical use of results
- Our tests and reports are provided for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.
- You must not rely solely on our test results to make medical or lifestyle decisions. Always seek advice from a qualified healthcare professional.
- We accept no liability for actions or decisions taken without appropriate medical consultation.
10.4 Factors beyond our control
We are not responsible for:
- Laboratory processing errors outside our reasonable control
- Delays in receiving results caused by postal, courier, or laboratory issues
- The accuracy of results where affected by undisclosed medical conditions, recent illness, medications, or failure to follow instructions
11. YOUR RESPONSIBILITIES
You must:
- Provide accurate medical history where requested
- Disclose relevant medications or conditions
- Follow all instructions carefully
- Seek medical advice for concerning results
- Not use services for illegal purposes
- Not provide samples from third parties without authorization
12. DATA PROTECTION
12.1 Your personal and health data is processed in accordance with our Privacy Policy.
12.2 By using our services, you consent to:
- Sharing necessary data with laboratory partners
- Retention of results for legally required periods
- Use of anonymized data for service improvement
13. INTELLECTUAL PROPERTY
All content, systems, and processes remain our property or that of our licensors. You may not reproduce, distribute, or create derivative works without permission.
14. COMPLAINTS
14.1 For service and clinical complaints: support@newfoundland.io
14.3 We aim to acknowledge complaints within 2 working days and resolve within 10 working days.
15. GOVERNING LAW
These terms are governed by English law. The English courts have exclusive jurisdiction.
16. CHANGES TO TERMS
We may update these terms. Continued use after changes constitutes acceptance.
17. SEVERABILITY
If any provision is invalid or unenforceable, the remainder continues in full force.
